In addition to our recent published results below are some of our additional successes:

  • We successfully enforced and collected a large judgment on behalf of our client by freezing the bank accounts of the judgment debtor.
  • We successfully moved to dismiss a complaint filed against individual members of a condominium sponsor. The case, brought forward by the condominium’s Board of Managers claimed breach of contract, breach of common law implied warranty of habitability, fraud, and negligent misrepresentation was dismissed
  • We successfully negotiated a favorable settlement on behalf of our client who was sued for $7 million on an alleged default of a loan agreement.
  • We successfully obtained a Yellowstone injunction for our client, which prevented a 50-year multi-million-dollar leaseholder from being evicted from the premises.
  • We successfully negotiated a short payoff on behalf of our client in a foreclosure action with a private lender.
  • We were successful in opposing the defendants’ motion to dismiss a complaint we filed seeking damages for breach of contract and unjust enrichment.
  • After nearly a three-month trial, we obtained a jury verdict in favor of our clients in a suit for a breach of an alleged joint venture agreement related to a billion-dollar real estate development project in Midtown, Manhattan. The jury found in favor of our client in all aspects of the case, leaving the client with zero liability.
  • We defended an appeal before the Court of Appeals for the Second Circuit Court in an action brought for our client seeking damages for violations of the client’s First Amendment rights, malicious prosecution, and improper seizure of property.
  • We successfully negotiated a favorable settlement on behalf of a client in an action for false arrest, malicious prosecution, and personal injury. The case was pending in Federal Court against the City of New York and several other defendants.
  • We have commenced a discrimination claim on behalf of our client with the Division of Human Rights on the basis that a prospective employer refused to hire him because he was a Sabbath observer. The DHR found that probable cause existed to believe that the client was discriminated against.
  • We successfully opposed a petition seeking to confirm an arbitration award. Our cross-motion to vacate the arbitration award was granted.
  • We successfully obtained a multi-million dollar settlement in a breach of contract matter on behalf of our client. The client had a claim of breach of contract related to an agreement to develop real estate in New York City.
  • After aggressive and vigorous litigation in a federal action brought against our client seeking $900,000 in damages, a settlement of $4,000 in damages was reached on behalf of our client.
  • We were successful in our motion to dismiss a claim brought against our client by a large, powerful national bank relating to a mortgage agreement.
  • We successfully moved to discharge a mechanic’s lien on behalf of our clients, a large real estate developer and contractor.
  • We successfully moved to amend a judgment to act as a lien against the defendant’s real property. Defendant’s counsel vehemently opposed our efforts, but Justice Demarest of the Commercial Division in Kings County ultimately sided with us.
  • We were successful in defeating the defendants’ motion for summary judgment on a breach of an implied brokerage contract with its client, a real estate broker. The client was seeking to recover commissions earned on a real estate transaction. We were then able to secure a settlement favorable to our client.
  • We successfully moved to dismiss a foreclosure action brought against our client by a large bank. The motion was based on a lack of compliance with the requisite pre-action notices required to be served by the bank.
  • A large hospital sued and obtained a default judgment against our client. After filing a motion seeking to vacate the default judgment, we successfully convinced the plaintiff hospital to dismiss, with prejudice, all claims against our client based on legal and equitable principles.
  • We successfully negotiated a settlement agreement with a lender who sought to enforce a loan of $1,500,000, as well as personal guarantees. We obtained an extremely favorable settlement.
  • We sued and successfully settled a case against a major bank for fraud relating to a home mortgage. The claims against the bank were for RESPA, TILA, and predatory lending. We ultimately reached a favorable settlement in which the bank agreed to pay our client a lump sum as damages and agreed to a permanent loan modification.
  • We obtained a favorable settlement for our client against an institutional lender. We successfully raised numerous lender liability issues regarding the bank’s loan. The settlement totaled several hundred thousand dollars.
  • We successfully moved to dismiss several causes of action on behalf of our clients, condominium sponsors, in litigation with the condominium’s board of managers for breach of contract and several other causes of action. The claims alleged that the construction was not in accordance with the offering plan of the building.
  • In a complex federal action, we were successful in dismissing fraudulent conveyance claims against our client, with prejudice. Plaintiff sought over $1,000,000 in damages.
  • We successfully represented our client in an action against the client’s employer for breach of an employment contract. We settled the case for several hundred thousand dollars.
  • We successfully obtained summary judgment in favor of our client. The client sought a return of a $250,000 down payment relating to a real estate contract. In addition to a return of the deposit, we were able to collect interest plus attorney fees.
  • We successfully moved to dismiss an action and discharge a lis pendens filed against our client’s property on the basis that the alleged agreement violated the Statute of Frauds.
